On Sept 22nd, TPD Chief Kasmar released statement to Chris DeSimone on WakeUP! Tucson, the KVOI.com radio show, blasting failure of justice. Below is the text of the quote and then a link to Chris DeSimone reading the quote Kasmar submitted to him.
"I couldn't be more disappointed with the decision made by the judge in this case. This case highlights the need for increased judicial transparency and accountability.
Well if larimer county wyoming can address the attorneys that failed to uphold their obligations to the people of larimer county. Over 400 criminal cases not prosecuted. The people of tucson can also address the failed obligations of their attorneys. The attorney in larimer county wyoming lost their law license. Get busy citizens of tucson! Be the change you want to see.
The Police Chief is complicit in all that is unveiling in Pima County and the City of Tucson. This wide-eyed “we must do something to change this course” song is discordant and abusive to the senses. For many years this chief had opportunities to deflect and intervene in all of this but chose consciously and of sound mind to NOT do anything but rather to let it play out. I am not sure what the last straw was for him but it may be too little too late. At what price was securing the mantle of leadership? Now, he asks for change. Perhaps he could have become the change he would like to see years ago.
“I sold the car 2 or 3 weeks ago but did not remove the plate or transfer title.”
“I plead guilty. I was not the shooter but take accountability for being an accomplice.”
What? Arizona Revised Statutes, 13-301 defines accomplice: “accomplice” means a person who with the intent to promote or facilitate the commission of an offense(manslaughter):
1. Solicits or commands another person to commit the offense; or
2. Aids, counsels, agrees to aid or attempts to aid another person in planning or committing an offense.
3. Provides means or opportunity to another person to commit the offense.
So what did he intend to promote or facilitate????
This is a November, 2020 shooting-shouldn’t this case have been tried to a jury within 4-5 months. Why the delay?
If you were an accomplice, you aided another or provided the means or opportunity to another knowing there was going to be a shooting.
A 37 yr old guy, working, probably 2 jobs, maybe 3, eliminated. For what? What a waste. Disgusting.
But chief, don’t blame the judge. He was presented this deal by the county attorney. Is he going to testify against his accomplices? That would be the thing to do now. He no longer as a fifth amendment claim.
Or will we just forget about it in 2 weeks as we forget everything else. “Blasting failure of justice” is an empty gesture playing to the public. What do the detectives who investigated the case have to say? They know what kind of case it was.
We’re still wondering why the guy who killed the little girl and is pending trial for killing another little girl didn’t get the death penalty?
Get the rest of the guys. Get the guy he was the accomplice to. Let’s stop “blasting” and get the rest of them.
