Mayor Romero and City Council's - "Tucson’s differential water rates ‘unreasonable as a matter of law,’ court rules"

Pima County sued, and won the lawsuit, against the City of Tucson for implementing higher water rates for County Residents without justification for the higher cost.

Instead of focusing on keeping us safe, they support drug addition and lawlessness in our city.  This judgement against Mayor Romero and Council is a reflection of more systemic problems with elected officials continuous failed policies being out-of-touch with who they are supposed to serve. Tucson City Council concentrates on creating failed policies that even extend beyond enabling Crime. A prime example of this is Mayor Romero and the City Council’s effort to extort Pima County residents who are forced to buy the basic-life giving commodity of water from only one available vendor: Tucson Water.  

Mayor Regina Romero and Council tried to pull the "race card" but the judge did not bite: 

"Tucson argues that Pima County lacks standing to claim race-based discrimination. According to its Response, Pima County does not make that claim."

Findings from the judge that even can be applied to the FREE CRIME BUS the Mayor is ramming down our throat.  Mayor and Council did not do their homework just like they are getting ready  to impose the $10,000,000 a year shortfall of the FREE CRIME BUS to our taxpayers.  They are being lazy, and this is another example of failure to lead.  Quotes from the judge:

What does “just and reasonable mean”? At the very least it means rates must be grounded in cost of service.

"Pima County argues that Tucson’s water rates for users in unincorporated areas are not “just and reasonable” as required by A.R.S. § 9-511.01."

"...persuasive cases from other jurisdictions support an interpretation that “just and reasonable” rates must be tied to cost."

"Second, A.R.S. § 9-511.01 requires a municipality raising water rates to prepare and publish “a written report or supply data supporting the increased rate” which includes “cash flow projections” showing anticipated revenues and expenses. A.R.S. § 9-511.01(A)(1). The Legislature would not have required that data if it did not intend rates would be tied to it."

    In rebuttal to Denise Meeks,
    candidate for Mayor JL Wittenbraker® supports ending fare-free transit and has this news report by a professional journalist objective and quoting witnesses as one of many reasons out there to support her position:

    ‘Sherry Schaefer rides the city bus every other day. Last Saturday, during her commute, she found herself calling Sun Tran while chaos ensued.

    “Trying to figure out how to calm down this couple they were very intoxicated, throwing food fights, threatening people, laying on the floor,” Schaefer said. “She even had her feet up on the seat going back and forth.”

    She wasn’t the only one on the bus trying to find a solution.

    “We had 70% of the bus, and it was pretty full by this time, complaining to the driver to pull over, ‘get them off please,’ and he’s not allowed to get involved,” Schaefer said…

    “I don’t feel safe,” Schaefer said. “I don’t feel safe if they’re told not to get involved it’s like being on a Tesla on autopilot. It’s gonna keep going.”

    Public transportation is still free …’

    Free fare Sun Tran crime express bus is an accurate description while the inflammatory part is the Romero-Cunningham-Santa Cruz administration planned new tax, instead of resuming bus fare to ride the bus, to cover the $10,000,000 a year shortfall of Sun Tran.

    “FREE fare suntran crime express.” I still can’t get over the fact that anyone thinks this is FREE. Nothing is free.
    You’re paying for it, whether it’s in reduced police services, garbage pick up, arrests and incarcerations. All those things the money could be spent on to make Tucson a great place, we spend on subsidizing suntran, cleaning up homeless camps, trying to get the druggies to rehab themselves. Forget it. Go home tonight and lock yourself behind your iron bars. Who’s being locked up?

    Cox is a private corporation and is under no obligation to make its event public.
    Referring to Tucson’s public transportation system as “the free fare Sun Tran crime express” and similar terms is inflammatory and inaccurate. Free transportation enables thousands of Tucsonans to get to work and to school. It is not a “public nuisance,” and privatizing it would do nothing to alleviate the conditions you claim exist on buses it would, however, make riding the bus more expensive.
